Trump just released his #immigrationban executive order (EO). Here is a quick round-up. For more detailed information, here’s a link to the Executive Order (EO).
The EO goes into effect on April 23, 2020 at 11:59 PM and runs for 60 days, with a possible extension. The EO only impacts non-citizens outside the United States who are seeking to enter the U.S. as immigrants, with some important exceptions for family members, healthcare workers, and investors who are immigrating to the United States. If you are already a permanent resident with a green card, you are not affected by the EO. If you are currently in the U.S. applying for a green card or any other immigration benefit, the EO does not affect you, since the EO only covers people outside the U.S. And, if you are coming to visit the U.S. on a non-immigrant visa (e.g., student, visitor, or temporary worker) the EO does not affect you. People with asylum or refugee status are also not affected.
So, who is covered? Trump’s EO bans entry for all non-citizens coming to the U.S. to immigrate, with several key exceptions:
- Holders of immigrant visas for spouses and children (under 21) of US citizens
- EB-5 investor visas.
- Holders of certain healthcare worker immigrant visas, and
The EO also makes exceptions for non-citizens outside the U.S. who are already holding an approved immigrant visa or are holding an advance parole travel document. If your immigrant visa was already approved prior to the EO start date, but are still outside the U.S. when the EO kicks in, you are not under the entry ban.
As for the fuckery, the EO will exclude parents of U.S. citizens, spouses of permanent residents, adult sons and daughters of both U.S. citizens and permanent residents, brothers and sisters of U.S. citizens, and the minor children of permanent residents. The EO however provides exceptions to spouses and family members of the U.S. Armed Forces, or where the non-citizen’s entry would be in the national interest of the United States.
